Terms of Service
These Terms of Service (hereinafter, the “Terms”) set forth the conditions for the use of the services (hereinafter, the “Service”) provided by Unimon Inc. (hereinafter, the “Company”) on this website. Users of the Service (hereinafter, “Users”) agree to these Terms to use the Service.
Article 1 (Application)
These Terms apply to all relationships related to the use of the Service between Users and the Company. In addition to these Terms, the Company may establish various rules (hereinafter, “Individual Provisions”) regarding the use of the Service. Such Individual Provisions shall constitute a part of these Terms. If these Terms conflict with Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified.
Article 2 (Registration)
Registration is completed when a person wishing to register applies in accordance with the method specified by the Company and the Company approves the application. The Company may refuse registration if it determines that any of the following reasons apply and has no obligation to disclose the reasons: (i) false information was submitted at registration; (ii) the applicant has violated these Terms in the past; (iii) any other case in which the Company deems registration inappropriate.
Article 3 (User ID and Password Management)
Users shall manage their User IDs and passwords for the Service at their own responsibility and shall not transfer, lend, or share them with third parties under any circumstances.
Article 4 (Prohibited Acts)
Users shall not engage in the following acts when using the Service:
- Acts that violate laws or public order and morals
- Criminal acts or acts related to crimes
- Acts that destroy or interfere with the functions of the Company’s servers or networks
- Acts that may interfere with the operation of the Company’s services
- Collecting or accumulating personal information of other users
- Impersonating other users
- Providing benefits, directly or indirectly, to anti-social forces in connection with the Company’s services
- Other acts that the Company deems inappropriate
Article 5 (Suspension of the Service)
The Company may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following apply: (i) maintenance or updates of the system for the Service; (ii) force majeure such as earthquakes, lightning, fire, power outages, or natural disasters; (iii) accidents that cause computers or communication lines to stop; (iv) any other case in which the Company deems it difficult to provide the Service. The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to such suspension or interruption, regardless of the reason.
Article 6 (Copyright)
Users shall publish or edit only information (text, images, videos, etc.) for which they own the necessary intellectual property rights or have obtained permission from the rights holders.
Article 7 (Restrictions on Use and Deregistration)
The Company may, without prior notice, delete posted data, restrict all or part of the use of the Service, or deregister a User if any of the following apply.
Article 8 (Disclaimer)
The Company shall be exempt from liability unless due to willful misconduct or gross negligence. Even if the Company is liable for any reason, liability shall be limited to the scope of ordinary damages and, in the case of paid services, to the amount of fees (or the equivalent of one month for ongoing services). The Company shall not be responsible for any transactions, communications, or disputes between Users and other Users or third parties regarding the Service.
Article 9 (Changes to the Service)
The Company may change the contents of the Service or suspend the provision of the Service without notice to Users and shall not be liable for any damages incurred by Users as a result.
Article 10 (Amendments to the Terms)
The Company may amend these Terms at any time without notice when deemed necessary.
Article 11 (Notices and Communications)
Notices or communications between Users and the Company shall be made by the method prescribed by the Company.
Article 12 (Prohibition of Assignment)
Users may not assign or pledge their contractual status or rights or obligations under these Terms to third parties without the prior written consent of the Company.
Article 13 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company’s head office.
